Separation and divorce are emotionally traumatic for both the people involved and for any children.  As members of the Solicitors Family Law Association, we are committed to helping you through your separation and divorce, and any negotiations relating to your children, your finances or property, with as little conflict and delay as possible.  Whenever possible, we shall find ways to resolve any differences with your spouse amicably and without resorting to the Courts.  If we cannot avoid court proceedings, we shall represent your interests assertively, whilst still encouraging ways to find a negotiated agreement. 

Mediation

Mediation is not marriage guidance. It can help people who are separating or divorcing. Mediation is a way for you to negotiate directly with your spouse or partner in a neutral place with a trained mediator to act a referee, but not as a judge.

Divorce

The only ground for divorce is the irretrievable breakdown of the marriage. In other words, you must be sure that there is no possibility of a reconciliation.

If your marriage has irretrievably broke down, you must be able to prove one of the following:

  • Your spouse has committed adultery and you find it intolerable to live with them.
  • Your spouse has behaved in such a way that you cannot reasonably be expected to live with them.
  • Your spouse has deserted you and you have lived apart for at least 2 years.
  • You and your spouse have already separated and have lived apart for 2 years and both agree to there being a divorce
  • You and your spouse have already separated and have lived apart for at least 5 years.

An undefended divorce goes through entirely on the paperwork and usually no attendance is required at court by you or your spouse. The entire divorce process takes approximately 4 to 6 months from beginning to end, although in most cases it can take nearer 12 months taking into account the time it takes to resolve the financials aspects of the divorce.
